By requesting services, registering for an account, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.
These Terms constitute a legally binding agreement between you and WOWFIX LLC (“WOWFIX,” “we,” “us,” or “our”).

2. DESCRIPTION OF SERVICES
WOWFIX provides professional window and door installation, repair, and maintenance services directly to residential and commercial customers throughout North Carolina. Our services include, but are not limited to:
– Window repair and replacement
– Door repair and replacement
– Glass repair and replacement
– Hardware repair and replacement
– Seal and weatherstripping replacement
– Foggy window repair
– Screen repair
– Emergency window and door services
All services are performed solely by trained and insured WOWFIX employees. We do not use or offer third-party subcontractors unless explicitly disclosed and agreed upon in writing.

3. ELIGIBILITY AND ACCOUNT REGISTRATION
Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use our services. By using the Platform, you represent and warrant that you meet these requirements.
Account Registration
You may browse our services without registering, but must create an account to request and schedule services. When registering, you agree to:
– Provide accurate, current, and complete information
– Maintain and promptly update your account information
– Keep your password secure and confidential
– Accept responsibility for all activities under your account
– Notify us immediately of any unauthorized account access
WOWFIX reserves the right to suspend or terminate accounts that contain false, misleading, or fraudulent information, or that violate these Terms.

4. YOUR USE OF THE PLATFORM
Permitted Use
You may use the Platform solely for lawful purposes in accordance with these Terms. You agree to use the Platform in a manner consistent with all applicable local, state, and federal laws and regulations.
Prohibited Conduct
You agree NOT to:
– Access or tamper with non-public areas of the Platform or our systems
– Share your account credentials or allow unauthorized access to your account
– Post inaccurate, fraudulent, defamatory, obscene, or misleading content
– Distribute spam, unsolicited communications, or attempt to collect personal data from other users
– Violate intellectual property rights of WOWFIX or third parties
– Attempt to reverse engineer, decompile, or compromise the security of the Platform
– Use automated systems (bots, scrapers) to access the Platform without permission
– Impersonate any person or entity or falsely state or misrepresent your affiliation
– Interfere with or disrupt the Platform or servers/networks connected to the Platform
– Use the Platform for any illegal or unauthorized purpose
Violation of these prohibitions may result in immediate termination of your access and potential legal action.

5. SMS AND TEXT MESSAGE COMMUNICATIONS
Consent to Receive SMS
By providing your mobile phone number and opting in, you expressly consent to receive text messages from WOWFIX, including:
– Service appointment confirmations and reminders
– Technician arrival notifications and updates
– Service status updates and completion notifications
– Payment confirmations and receipts
– Account notifications and security alerts
– Promotional offers (if you opt in to marketing messages)
Message and data rates may apply. Message frequency varies based on your service requests.
SMS Terms
– You may opt out at any time by texting STOP to any WOWFIX message
– Text HELP for assistance or contact us at the information below
– We use Twilio Inc. as our SMS service provider
– Consent to receive SMS is not required to purchase services
– All major U.S. carriers are supported
– We comply with the Telephone Consumer Protection Act (TCPA)

6. SCHEDULING AND APPOINTMENTS
Service Requests
When you request services through the Platform, you authorize WOWFIX to contact you via phone, email, or SMS to confirm details and schedule an appointment.
Appointment Scheduling
– Appointments are subject to availability and confirmation by WOWFIX
– We will make reasonable efforts to accommodate your preferred date and time
– You will receive confirmation via your preferred communication method
– We may need to reschedule due to weather, emergencies, or unforeseen circumstances
Appointment Window
Service appointments are typically scheduled in 2-4 hour windows. We will notify you when our technician is en route to your location.
Access Requirements
You must ensure that our technicians have safe and reasonable access to the work area. If access is denied or restricted, we may need to reschedule and may charge a service call fee.

7. CANCELLATIONS AND RESCHEDULING
Your Cancellations
You may cancel or reschedule appointments through the Platform, by phone, or via SMS, subject to the following:
– Cancellations made 24+ hours before scheduled appointment: No charge
– Cancellations made less than 24 hours before appointment: May incur $75 cancellation fee
– No-show or same-day cancellation without notice: $150 cancellation fee
WOWFIX Cancellations
We may need to cancel or reschedule appointments due to:
– Severe weather or unsafe working conditions
– Technician illness or emergency
– Equipment or parts unavailability
– Safety concerns
If we cancel, you will receive full credit or refund for any fees paid, and we will work with you to reschedule at your earliest convenience.

8. PRICING, PAYMENTS, AND FEES
Service Quotes
All service quotes provided are estimates based on information you provide. Final pricing may vary based on actual conditions discovered during service. We will notify you of any significant price changes before proceeding with work.
Payment Terms
– All fees are stated in U.S. dollars
– Payment is due upon completion of services unless otherwise agreed in writing
– We accept major credit cards, debit cards, and ACH transfers
– You authorize WOWFIX to charge your selected payment method for all services rendered
– Prices do not include applicable sales tax, which will be added to your invoice
Late Payments
Invoices not paid within 30 days are subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.
Deposits
For certain projects exceeding $2,000, we may require a deposit of up to 50% to secure materials and schedule work.

9. REFUNDS AND SATISFACTION GUARANTEE
Our Commitment
We stand behind our work and strive for 100% customer satisfaction. If you are not satisfied with our services, please contact us within 7 days of service completion.
Refund Eligibility
Refunds may be issued in the following circumstances:
– Services not performed as agreed
– Material defects in workmanship (covered by warranty)
– Services canceled by WOWFIX before work begins
– Billing errors or duplicate charges
– Services not meeting reasonable quality standards
Non-Refundable Items
The following are generally not eligible for refunds:
– Services completed to your satisfaction and specification
– Custom-ordered materials or parts (unless defective)
– Diagnostic or service call fees if work is declined
– Change of mind after service completion
– Normal wear and tear after service
– Cancellation fees as outlined in Section 7
Refund Process
To request a refund, contact us at the information provided below. We will review your request and respond within 7 business days. Approved refunds will be processed within 10 business days to your original payment method.

10. WARRANTY AND GUARANTEES
Service Warranty
WOWFIX warrants that all services will be performed in a professional and workmanlike manner. We offer the following warranties:
– Labor Warranty: 1 year from service completion date
– Parts Warranty: Varies by manufacturer (typically 1-10 years)
– Glass Warranty: Manufacturer warranty applies (typically 10-20 years for IGU seals)
Warranty Coverage
Our warranty covers defects in workmanship and materials. If covered issues arise during the warranty period, we will repair or replace at no additional charge.
Warranty Exclusions
Warranties do not cover:
– Damage caused by accidents, misuse, or abuse
– Normal wear and tear
– Damage from extreme weather events (hurricanes, hail, etc.)
– Alterations or repairs by non-WOWFIX technicians
– Failure to maintain products as recommended
– Pre-existing conditions not addressed in original service
To make a warranty claim, contact us with your service invoice number and description of the issue.

11. LIABILITY AND INSURANCE
Our Insurance
WOWFIX maintains general liability insurance and workers’ compensation insurance for all employees. Proof of insurance is available upon request.
Your Property
We take reasonable care to protect your property during service. However, we are not responsible for:
– Pre-existing damage to surrounding areas
– Damage to landscaping necessary to access work areas
– Contents left in work areas that you were advised to remove
– Hidden defects discovered during service (we will notify you)
You should notify your homeowner’s insurance of any major repair or installation work.

12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE PLATFORM AND RELATED SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WOWFIX DISCLAIMS ALL WARRANTIES, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WOWFIX DOES NOT WARRANT THAT THE PLATFORM WILL OPERATE ERROR-FREE, VIRUS-FREE, OR WITHOUT INTERRUPTION.
IN NO EVENT WILL WOWFIX’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO WOWFIX IN THE 12 MONTHS PRECEDING THE CLAIM.
WOWFIX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
Some jurisdictions do not allow limitation of implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
Emergency Services Disclaimer
While we offer emergency services, we cannot guarantee immediate availability. In life-threatening situations, always call 911 first.

13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless WOWFIX LLC, its officers, directors, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:
– Your use or misuse of the Platform
– Your violation of these Terms
– Your violation of any rights of another party
– Any content you submit or transmit through the Platform
– Your negligence or willful misconduct
This indemnification obligation survives termination of these Terms and your use of the Platform.

14. DISPUTE RESOLUTION
Informal Resolution
If you have a dispute with WOWFIX, please first contact us to attempt to resolve the matter informally. Most concerns can be resolved quickly through direct communication.
Binding Arbitration
If we cannot resolve a dispute informally, you agree that any dispute arising out of or relating to these Terms or our services will be resolved through binding arbitration rather than in court, except that:
– You may assert claims in small claims court if they qualify
– Either party may seek injunctive or equitable relief in court
– Disputes regarding intellectual property may be brought in court
Arbitration Rules
– Arbitration will be conducted by the American Arbitration Association (AAA)
– AAA’s Commercial Arbitration Rules will apply
– Arbitration will take place in North Carolina
– The arbitrator’s decision is final and binding
– Each party pays their own costs unless awarded by arbitrator
Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You may not join or consolidate claims in arbitration with other customers unless WOWFIX agrees in writing.

15. USER CONTENT AND INTELLECTUAL PROPERTY
Your Content
You retain ownership of any content you submit through the Platform (reviews, photos, messages, etc.). By submitting content, you grant WOWFIX a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display such content for business purposes, including marketing and testimonials.
Content Standards
You represent and warrant that:
– You own or have permission to share all content you submit
– Your content does not violate any third-party rights
– Your content is accurate and not misleading
– Your content does not contain viruses or malicious code
Our Intellectual Property
All content on the Platform, including text, graphics, logos, images, software, and design, is owned by WOWFIX or its licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.
Trademark
WOWFIX and related logos are trademarks of WOWFIX LLC. You may not use our trademarks without prior written consent.

16. TERMINATION OF ACCESS
Termination by You
You may terminate your account at any time by contacting us. Termination does not relieve you of any obligations for services already provided or fees incurred.
Termination by WOWFIX
We may suspend or terminate your access to the Platform at any time, with or without notice, for:
– Violation of these Terms
– Fraudulent, abusive, or illegal activity
– Providing false or misleading information
– Non-payment of fees
– Conduct that harms WOWFIX or other users
– Any other reason at our sole discretion
Effect of Termination
Upon termination:
– Your right to access and use the Platform immediately ceases
– We may delete your account data (subject to legal retention requirements)
– Provisions that by their nature should survive will remain in effect
– You remain liable for any outstanding fees or obligations
Data Retention
We may retain certain information after account termination as required by law, for legitimate business purposes, or to enforce these Terms.

17. MODIFICATIONS TO TERMS
WOWFIX reserves the right to modify these Terms at any time. When we make material changes:

– We will notify you via email, SMS, or prominent Platform notice
– Changes become effective 30 days after notice (or immediately for legal/security reasons)
– Your continued use after changes become effective constitutes acceptance
If you do not agree to modified Terms, you must stop using the Platform and may terminate your account.

18. MODIFICATIONS TO SERVICES
WOWFIX may modify, suspend, or discontinue any aspect of the Platform or services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.

19. GENERAL PROVISIONS
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WOWFIX regarding use of the Platform and supersede all prior agreements.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Waiver
Failure by WOWFIX to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
Assignment
You may not assign or transfer these Terms or your account without our written consent. WOWFIX may assign these Terms at any time without notice.
Force Majeure
WOWFIX is not liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, or government actions.
Relationship
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and WOWFIX.
Third-Party Rights
These Terms do not create any third-party beneficiary rights except as expressly stated.
Headings
Section headings are for convenience only and do not affect interpretation of these Terms.

20. GOVERNING LAW AND JURISDICTION
These Terms and any disputes arising out of or relating to these Terms or our services are governed by the laws of the State of North Carolina, without regard to its conflict of law principles.
Subject to the arbitration provisions in Section 14, you agree to submit to the exclusive jurisdiction of the state and federal courts located in North Carolina for resolution of any disputes.
